1. Who we are
Overtake: Taskbar Racer (the "Game") is developed and published by Rubens Games, a sole proprietorship registered in Poland:
Dawid Matuszewski, trading as Rubens Games
os. Przyjaźni 4/55, 61-682 Poznań, Poland
Tax ID (NIP): 9721218165
E-mail for privacy matters: kontakt@rubensgames.dev
We are the data controller within the meaning of the EU General Data Protection Regulation (GDPR) for the processing described in this policy. We have not appointed a Data Protection Officer because we are not required to; the contact above reaches the person responsible for data protection directly.
This policy covers the Game, our game server at rubensgames.dev and the ways you can contact us. It does not cover Steam, Discord or any other third-party service, each of which has its own privacy policy.
2. The short version
- The Game has no account system of its own. We do not know who you are unless you write to us.
- The Game contains no advertising and no tracking. We do not profile you and we never sell data.
- Gameplay analytics is optional and off by default. If you switch it on in the settings, the Game sends us anonymous-as-possible usage statistics (see 3.7). You can switch it off at any time.
- Leaderboards, achievements and in-game items (skins, cases) are provided by Steam and stored by Valve, not by us.
- Our own server only sends data to the Game (event and season schedule, item icons). The Game never uploads your progress or personal data to it. Like every web server, it keeps short-lived technical access logs.
- Discord Rich Presence is optional, talks only to the Discord app on your own computer and can be switched off.
- Because the Game runs on your Windows taskbar, it listens for keyboard and mouse input system-wide so you can drive while another window is focused. This input is used in real time only, never stored and never transmitted.
- If you send us a bug report, we receive what you put in it (contact details, description, screenshots, logs) and use it only to fix the problem.
3. What we process, why, and on what legal basis
3.1 Steam features
The Game is distributed on Steam and uses the Steamworks API provided by Valve Corporation. When you play, the Game reads and uses the following through Steam:
- Your Steam ID, your Steam display name and your Steam avatar, to identify you to Steam services and to show your own entry on leaderboards.
- The display names and avatars of your Steam friends, so that the friends view of a leaderboard can show them next to you. This data is read from Steam only when the leaderboard is displayed, is shown only on your own screen and is never sent to us or stored by us.
- Leaderboard scores: the distance you drive in a season and during limited-time events is uploaded to Steam leaderboards. Leaderboards are visible to other Steam users.
- Achievements and stats used to unlock achievements.
- Your Steam Inventory for this Game: item drops, opening cases, trading up items, consuming items and equipping skins. Items are created, stored and transferred by Valve's Steam Inventory Service.
The Game does not use Steam Cloud. Your save file stays on your computer (see 3.4).
All of this data is stored by Valve on Valve's systems under the Steam Privacy Policy. We do not copy it to our own servers. Your Steam privacy settings control who can see your profile, inventory and game details.
3.2 Our game server (rubensgames.dev)
At start-up, and periodically while running, the Game downloads from our server:
- the schedule of seasons and limited-time events (a small configuration file), and
- images of in-game items (car models, backgrounds, helmets, stickers, tyres, speedometers, cases) used as icons in the garage.
These are plain downloads. The Game does not send your Steam ID, progress, save data, name or any other personal data to our server.
As with every web server, our hosting provider automatically records access logs containing your IP address, date and time of the request, the address requested, the response code and the user agent string of the Game's networking library. We use these logs solely to keep the service running, to diagnose faults and to protect the server against abuse. We do not link them to any Steam account.
3.3 Discord Rich Presence
If the Discord desktop app is running on your computer, the Game can show what you are doing as your Discord activity ("Rich Presence"). To do this, the Game sends short status text to the Discord app installed on your own computer through a local connection. The text can include: whether you are racing or in the garage, your current rank and season, the distance driven in the session, and the name and picture of the car you are using, plus a button linking to our website.
Nothing is sent to us. Discord Inc. receives the status text from its own app and displays it to your Discord contacts according to your Discord privacy settings; that processing is covered by Discord's Privacy Policy.
You can hide the details (rank, distance, car) with the "show details" option in the Game's settings, and you can disable game activity entirely in Discord under User Settings > Activity Privacy. The feature does nothing if Discord is not running.
3.4 Data kept only on your computer
The Game stores the following locally, in the Windows user profile of the account you play on:
- Your save file: progress, coins, upgrades, unlocked content, statistics (for example total distance and time played), settings, and a snapshot of your last completed season used for the "Season Wrapped" summary card.
- The Season Wrapped card, if you choose to save it, is written as an image to your Pictures folder. Sharing it anywhere is your own action.
- Technical log files written by the Unity engine (Player.log). These contain diagnostic information such as your operating system and graphics hardware, and file paths that typically include your Windows user name.
None of this leaves your computer unless you attach it to a bug report yourself (see 3.5).
3.5 Bug reports and support
The Game contains a bug report form. When you submit it, we receive the information you enter and attach:
- your e-mail address,
- your Discord username and your Steam display name, if you provide them,
- your description of the problem,
- screenshots taken in the Game, if you attach them, and
- crash and log files, if you attach them. Note that log files can contain your Windows user name (in file paths), your Steam ID and details of your hardware and operating system.
Reports are delivered to our dedicated support mailbox overtakereports@gmail.com (Gmail, operated for us by Google LLC) or to our own issue-tracking system hosted on our server (OVH SAS, France). Only the people working on the Game can read them.
Please check screenshots and logs before sending them and remove anything you do not want us to see. Do not include passwords, payment details or other people's personal data.
The same applies if you e-mail us or contact us on our Discord server: we process what you send us in order to reply and to fix the problem.
3.6 System-wide keyboard and mouse input
The Game is designed to run on the Windows taskbar while you work in other programs. To let you control the car when another window has focus, the Game registers low-level Windows input hooks (WH_KEYBOARD_LL and WH_MOUSE_LL, provided by the open-source Desktopia library). This means the Game is notified of key presses and mouse events across the system while it is running.
The Game uses these events only to react in real time (for example to detect the accelerate key). It does not record keystrokes, does not log them, does not read what you type into other programs and does not transmit anything about your input anywhere. The hooks are removed when the Game exits. Some antivirus products may flag global input hooks; this is expected behaviour of the technique.
3.7 Optional gameplay analytics
The Game has a "Share anonymous usage statistics" option in its settings. It is off by default and nothing described in this section is collected until you switch it on.
When enabled, the Game periodically sends the following to our server:
- a random identifier generated by the Game for this purpose (not your Steam ID, not your name),
- game version, operating system version, screen resolution and a general hardware class (for example graphics card family),
- how you play: session length, distance driven, which features and screens you use, which cars and upgrades you pick, in-game economy events (coins earned and spent, cases opened),
- with the separate "share my Steam library" option: the list of games on your Steam account and which of them you have played recently, obtained through the Steam Web API. This works only if your Steam profile and game details are set to public in your Steam privacy settings. We use it to understand what else our players enjoy and to plan features and events.
We use these statistics to see which parts of the Game are used, to balance the economy and to plan updates. We look at them in aggregate. We do not use them to make decisions about individual players, we do not sell or share them and we do not combine them with bug reports or support e-mails.
You can switch either option off at any time in the settings. Switching off stops further collection immediately; data already sent is deleted within 30 days of your request to kontakt@rubensgames.dev, or otherwise after the retention period below.
4. What we do not do
- No advertising or ad networks.
- No third-party analytics, telemetry, crash reporting or tracking SDKs. The Game does not use Unity Analytics, Unity Cloud Diagnostics or any similar service. The only analytics is our own optional, opt-in statistics described in 3.7.
- No user accounts, e-mail lists or newsletters through the Game.
- No sale or rental of personal data, no data brokers.
- No automated decision-making or profiling (Art. 22 GDPR).
- No processing of special categories of data.
5. Who receives data
- Valve Corporation (USA): independent controller for all Steam data (section 3.1). Valve's transfers of your data outside the EEA are made under Valve's own safeguards, described in the Steam Privacy Policy.
- Discord Inc. (USA): independent controller for Rich Presence data displayed through your Discord account (section 3.3).
- OVH SAS (France, EU): our data processor, hosts rubensgames.dev, the issue-tracking system and the analytics data described in 3.7.
- Google LLC (USA): our data processor for the support mailbox (Gmail). Google is certified under the EU-U.S. Data Privacy Framework, which the European Commission recognises as providing adequate protection; Google's Standard Contractual Clauses apply in addition.
We do not otherwise transfer personal data outside the European Economic Area.
We may disclose data if required to do so by law or by a binding order of a court or authority.
6. How long we keep data
- Server access logs: up to 30 days.
- Bug reports and support correspondence: until resolved, then up to 24 months.
- Analytics data (3.7): 24 months from collection, then deleted or reduced to aggregate figures that cannot be linked to you; deleted earlier on request or when you withdraw consent.
- Steam and Discord data: held by those companies, not by us.
- Data on your computer: until you delete it. Uninstalling the Game does not necessarily remove the save file and logs; they are in
%USERPROFILE%\AppData\LocalLow\Rubens Games\Overtake.
7. Your rights
Under the GDPR you have the right to:
- access the personal data we hold about you and receive a copy (Art. 15),
- have inaccurate data corrected (Art. 16),
- have your data erased (Art. 17),
- restrict processing (Art. 18),
- receive data you provided to us in a portable format (Art. 20),
- object to processing based on our legitimate interests (Art. 21), and
- withdraw consent at any time where processing is based on consent, without affecting processing carried out before withdrawal.
To exercise these rights, e-mail kontakt@rubensgames.dev. We will answer within one month. Because we hold very little data and cannot link server logs to a person, we may need you to provide the e-mail address or Discord/Steam name you used when contacting us so that we can find your records.
For data held by Valve or Discord (your Steam profile, leaderboard entries, inventory, Discord activity), please use the tools and contact channels those companies provide; we cannot delete or export data stored on their systems.
You also have the right to lodge a complaint with a supervisory authority. In Poland this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, uodo.gov.pl). You may also complain to the authority of the EU country where you live or work.
8. Children
Steam requires its users to be at least 13 years old. The Game is not directed at children and we do not knowingly collect personal data from anyone under 16 (or the lower age set by your country's law; it is 16 in Poland). If you believe a child has sent us personal data, contact us and we will delete it.
9. Security
Our server is reachable over HTTPS only. Access to the server, the support mailbox and bug reports is limited to the developers of the Game and protected by strong authentication. We keep as little data as we can, which is the best protection we can offer.
10. Changes to this policy
We will update this policy when the Game gains features that change how data is processed. The date at the top shows the current version. Significant changes will also be announced in the Game's Steam community hub.
